Your Take: Should DUI Alcohol Limit Be Lowered To 0.05 Percent?

The National Transportation Safety Board recommends reducing the limit. Some say it would save lives. Others say it's unreasonable.

One drink could be the standard for drunken driving—at least for some people if the National Transportation Safety Board has its way.  On Tuesday, the NTSB recommended states lower the blood-alcohol threshold for driving under the influence from 0.08 percent to 0.05 percent. About 10,000 deaths a year are related to drunken driving. The NTSB says the lower limit would save 500 to 800 lives a year. Officials at the American Beverage Institute called the proposal "ludicrous." It said the average woman could reach the 0.05 percent limit by having one drink. Lowering the limit to .05 is a stupid idea. The current .08 isn't much better. The problem is that even now there is no way for a person to know whether they are over the limit or not. As an avid motorcycle rider, I agree with all of you that texting is the most pervasive new problem, but it is impaired driving that we're all talking about either way. Don't be driving under the influence at any time—and if you are DUI, you can get arrested if you drive through downtown Geneva in the wee hours of the morning. Batavia Woman Sentenced to Prison for 4th DUI

Jeanette Baum, 32, of Batavia, was sentenced by Circuit Judge John A. Barsanti to four years in the Illinois Department of Corrections.

A Batavia woman has been sentenced to prison for being under the influence of alcohol when she crashed her car after she drove her child to school late last year. Jeanette Baum, 32, of the 0-99 block of North Lincoln Avenue, Batavia, was sentenced Friday by Circuit Judge John A. Barsanti to four years in the Illinois Department of Corrections. On Jan. 4, 2013, Baum pleaded guilty to one count of aggravated driving under the influence, a Class 2 felony. At about 8:55 a.m. Nov. 27, 2012, Batavia police, responding to a 911 call, found Baum sitting in the driver’s seat of a white 2002 Mitsubishi Galant. The car was stalled after having crashed into a utility box near North Avenue and North Jefferson Street. Officers detected a strong odor of …

DUI Arrests Include Aggravated DUI, 'Dazed' Driver, Drug Paraphernalia

Aggravated DUI—Batavia police arrested Beligca Marrero, 27, of Aurora on charges of aggravated driving under the influence, unlawful possession of drug paraphernalia, improper lane usage, no valid driver’s license, and state citations of DUI and DUI with a blood-alcohol content of more than .08, Batavia police reports said. The arrest took place around 12:21 a.m. April 4 in the 1100 block fo South Batavia Avenue. Marrero was transported to the Kane County Jail. DUI Alcohol—Batavia police arrested Michael J. St. Patrick's Day No-Refusal Weekend Nets 3 Drunken Driving Arrests

Three drunken driving arrests—one in Geneva and two in St. Charles—were one result of Kane County’s St. Patrick’s weekend No-Refusal operation, officials announced Tuesday, April 2. The no-refusal weekend is a collaboration between the Kane County State’s Attorney’s Office and five law-enforcement agencies: Batavia, Elburn, Geneva, South Elgin and St. Charles. Authorities obtained three blood-alcohol concentration samples — all breath samples. Of the three samples obtained, two were more than twice Illinois’ threshold of .08, and one was in excess of three times the .08 threshold. You have a right of travel, not a right to drive. If you do not want to obey the law then there are consequences. If you want to fight it get drunk get a dui that way you will have standing standing with the court. But that is a lot of money to find out that you are wrong.   more ›

DUI Arrests Made on State Street, Randall Road

Two drivers from out of town will find themselves at the Kane County Judicial Center in March after arrests from driving under the influence in Geneva. Here are the police reports: DUI—Geneva police arrested Sara Tobler, 32, of Chicago on charges of driving under the influence and failure to reduce speed to avoid an accident at around 10:33 p.m. Feb. 9 after a traffic stop in the 100 block of West State Street, reports said. Tobler posted $100 bond and has a court date of March 6 at the Kane County Judicial Center, reports said. DUI—Geneva police arrested Manuel Aceves, 44, of Aurora on charges of driving under the influence, operating an uninsured motor vehicle and having no valid driver’s license after a traffic stop at around 5:45 p.m. …

Post-Beehive DUI Crash Fuels St. Charles Tavern Debate

St. Charles police send a report to the Liquor Commission after a Beehive patron drives into a parked car with a blood-alochol content three times the legal limit.

St. Charles police have forwarded a report to the city Liquor Commission after a woman had an accident within minutes of leaving The Beehive Tavern, 204 W. Main St., early Friday. No one was hurt in the crash, but police said the woman’s blood-alcohol content was three times the legal limit. Police described the woman, whose blood-alcohol content was .248, as “extremely intoxicated,” and the report concludes that the tavern either overserved alcohol to the woman or allowed her to remain on the premises in an intoxicated state, both of which violate the city’s liquor code. Kathryn Dale Doepke, 22, of the 100 block of South 3rd Street, was charged with driving under the influence of alcohol, DUI with a blood-alcohol content greater than .08…

Speeding at 104 Draws DUI for St. Charles Man

St. Charles man’s speeding stop turns into DUI arrest as well in Kendall County.

Monday night’s arrest of a St. Charles man in Kendall County brings one more proof to the truth of the expresion, one thing leads to another. James D. Peters, 50, of the 6N200 block of Woodland Drive, was driving on Route 71 near Legion Road, southwest of Yorkville, when a Kendall County sheriff’s deputy clocked him driving 104 mph in a 55 mph zone about 10:27 p.m. Although the report lacked details, it did state that Peters’ arrest on a charge of speeding was followed with a charge of driving under the influence of alcohol.   Click the "Keep Me Posted" button below this text.

Public Intoxication, Criminal Damage to Property Under $300—Someone pried open the trunk of a Chrysler Sebring sometime between noon Jan. 3 and 11:30 a.m. Jan. 4, reports said. The owner told police he observed the trunk to be slightly ajar when he left the Persinger Recreation Center, 3507 Kaneville Road, at around 11:30 a.m. Jan. 4, but he was unsure whether the damage occurred there.
