South Elgin Sex Predator Gets 40-Year Prison Term

A South Elgin man, who last year was sent to prison for possessing multiple images of child pornography was sentenced Thursday to an additional prison sentence for sexually preying on and assaulting a young girl he knew.

Circuit Judge David R. Akemann sentenced William S. Muth, 46, of the 1400 block of Blackhawk Circle, South Elgin, to 40 years in the Illinois Department of Corrections, according to a release issued by the Kane County State’s Attorney’s Office.

According to the release, Muth was convicted June 20, 2012, by a Kane County jury, of six counts of predatory criminal sexual assault, each a Class X felony, and two counts of aggravated criminal sexual assault, each a Class 2 felony.

Between Jan. 1, 2007, and Feb. 7, 2008, Muth had sexual contact multiple times with a young girl he knew. She was younger than 13 at the time.

The state’s attorney’s office said the sentence breaks down as six years for each of the predatory criminal sexual assault charges, to be served consecutively, or one after another, for a total of 36 years. He also was sentenced to four years for each of the aggravated criminal sexual assault charges, those sentences to be served concurrently (at the same time), for a total of four years. The 36-year term and the four-year term are to be served consecutively.

Muth must serve at least 85 percent of the 36-year term, and he was eligible for day-for-day credit on the four-year term.

On April 15, 2011, Muth was sentenced in Kane County court to three years in prison for his October 2010 conviction of 22 counts of possession of child pornography, each a Class 3 felony. The sentences issued Thursday will begin when Muth has completed his sentence for the child pornography conviction.

The case was investigated by the Kane County Child Advocacy Center and the South Elgin Police Department.
