Mom Alleges Son Bullied in Suit Against District 303, Parents

A woman has sued the St. Charles school district and the parents of a boy she alleges bullied her son and then hurt him after the district decided to keep the boys separated while they attended Davis Primary School, The Courier-News reports.

The lawsuit, which seeks more than $50,000, attorney fees and any other remedy ordered by the court, was filed in Kane County on Thursday. It was filed on behalf of Tracie Hunley and names as defendants St. Charles Community Unit School District 303 and the parents of the boy accused of bullying her son, who is now 11, according to The Courier-News.

Hunley’s son attended Davis Primary School in 2012-13 and the suit alleges he was being bullied by another Davis student, so the district decided to keep the two separated whenever they were on school grounds.

But according to the lawsuit, on Oct. 16, 2012, the two boys had a supervised recess together, when the other student allegedly hit Hunley’s son, who fell and suffered “serious and permanent” injuries.

The lawsuit’s allegations include that the district did not take the steps needed to prevent the two boys from coming into contact, and that the other student’s parents failed to take action to prevent him from coming into contact with Hunley’s son or discipline him for the alleged bullying.
