Board Members Want to Know Why 1,000 Kane DUI Records Didn't Get Sent to State

Some Kane County Board members are asking the state's attorney to investigate why the Kane County Circuit Clerk's Office failed to transfer more than 1,000 DUI and other driving records to the state of Illinois.

According to reports in the Kane County Chronicle, driving-arrest records from 2002 to 2008 were not electronically transferred to the Secretary of State's Office during the administration of former Kane County Circuit Clerk Deborah Seyller.

The Chronicle reports that two board members—Mark Davoust of St. Charles, and Michael Kenyon of South Elgin—hand-delivered a letter Friday to the Kane County State’s Attorney Office asking State's Attorney Joe McMahon to "immediately investigate" what happened and determine whether a criminal investigation is warranted.

The records were supposed to be sent to the Secretary of State's Office electronically, but didn't go through because of a computer glitch, the Chronicle story reports.

The issue was discovered last fall, and Seyller's office began going through documents by hand to ensure that all records were reported. The hand sorting is continuing under Circuit Clerk Tom Hartwell, who was elected in November.

Part of the problem is that the Secretary of State's Office relies on those records to issue license suspensions. Because of the long delay, some drivers were notified years after the offense that the state was suspending or revoking their driver's licenses.

Davoust and Kenyon called for the investigation because they said the matter is "a clear concern to public safety," the Chronicle reports.
