Sexual Assault Trial for Missing Man Will Go On, Even If He's Not Found

Enrique Ruiz was reported missing at around 1 p.m. Sunday, Nov. 24, and authorities believe he has fled to Texas in hopes of reaching Mexico.

The Kane County State's Attorney's Office is expected to go to trial next week as scheduled, even if sexual-assault suspect Enrique Ruiz has not been found.

Ruiz was reported missing at around 1 p.m. Sunday, Nov. 24, when sheriff’s deputies were called to a house in the 0-10 block of North Farnsworth in Aurora for a report of a senior citizen who has been missing since the previous Friday.

Ruiz told relatives he was going out for a walk and never returned.

Sheriff's officials followed up with a press release a few hours later saying the 85-year-old man is facing criminal sexual assault charges and may have fled to Mexico.

Ruiz is scheduled for trial next week in Room 313 of the Kane County Judicial Center before Judge James Hallock, according to the weekly court trial list.

Ruiz is charged with sexually assaulting a young girl over several years. He faces two counts of predatory criminal sexual assault and aggravated criminal sexual abuse for assaults that allegedly took place from 2004 through 2010. He was arrested in 2011 and was free on bail, according to an article in the Daily Herald.

Authorities believe Ruiz fled and might be in Texas, likely waiting to cross the border into Mexico, according to a report in The Courier-News. The Kane County Sheriff's Office said Ruiz has a home in Mexico City.

Ruiz's trial is scheduled for Dec. 9, but there is at least one additional complication.

A child pornography case out of Aurora for Oscar Mendez 10CF1852 is scheduled in the same Courtroom, 313, in front of Judge Hallock.

"If both go to trial as scheduled, and it is likely they will, one case will be heard by a different judge in a different courtroom," Public Information Officer Christopher Nelson said in an email.

Ruiz is described as 5 foot, 7 inches tall, 150 pounds, with gray hair, wearing blue jeans a blue jacket and an unknown color sweater.
