In Courts: D303 Lawsuit, Babysitter Sex Assault and Man Charged with ID Theft After He Buys Jaguar

Here's what's happing in courts in St. Charles, Geneva and around the area.

Among the interesting items in court this week are the case of the found 10,000-peso bill, St. Charles School District lawsuit progress, DNA testing on the sex-assault charges, the Darien trip-murder case and the guy who allegedly stole someone's identity and then was caught trying to buy a Jaguar.

KANE COUNTY

St. Charles—Parents group's lawsuit against School District 303 is in federal court is scheduled for a May 26 hearing, at which the judge is likely to decide—again—whether the case should stay in federal court or be sent back to Kane County. Still to be reported is whether the district has filed a response to the amended complaint filed by the parents' group.

St. Charles—Michael Listy, charged with sex assault of babysitter, returns to court on May 27. Prosecutors are still waiting on results of DNA testing after getting a sample from him last month.

St. Charles—The property-code case is scheduled for a hearing on May 27.


DUPAGE COUNTY

 Darien— returns to court May 25 for another hearing in his triple murder case. His attorney has been waiting on further results of psychological exams, but hasn't indicated any affirmative defenses at this point. Nodarse's mental state is emerging as a defense for co-defendant Johnny Borizov.

Darien—Sentencing for is still on for May 26 as of right now, the only hiccup could be that Judge Kinsella is in the middle of a murder trial that could stretch until Thursday. 

Elmhurst——Brian, Bryan and Steven—are all scheduled for hearings on May 24. These are likely status dates where trial dates could be set, based on what their attorney said recently.

Elmhurst—In an oddball ID theft case, Tyvon Graham was charged recently with using someone else's identity to buy a brand new Jaguar.

Glen Ellyn—The Ruisard v. Glen Ellyn dispute related to whether the village followed its own ordinance in approving returns to court on May 27 for what is expected to be a summary judgement ruling seeking to have the case dismissed.

Naperville—Remember the mom who went to court to claim a bill her daughter found? No one came forward for it, so a judge has granted their request to claim it.
