DUI-Drugs Arrest: Police Find Driver in Crash Asleep With Cell Phone in Hand

The following information was supplied by the Geneva Police Department. Where arrests or charges are mentioned, it does not indicate a conviction.

Geneva police arrested Spencer Fink, 21, of Naperville on charges of "DUI—combined influences" and unsafe lane usage after a crash around 5:05 a.m. Nov. 24 in the 0 to 99 block of South First Street, reports said. 

The front driver’s side of Fink's Acura TL collided with the rear of a parked Nissan Cube in the 0-99 block of South First Street, reports said. More than $1,500 damage was done to any one vehicle.

Fink was driving north in the 0-99 block of Route 31 approaching the intersection with West State Street, where he “appeared to have fallen asleep and drove off the roadway to the right,” reports said.

The Acura struck the Cube, which was parked off the roadway about 20 feet south of the intersection. When the officer arrived, Fink was asleep in the driver’s seat holding a cell phone in both hands, reports said.

Fink has a court date of 9 a.m. Dec. 14 at the Kane County Judicial Center, 37W777 Route 38, St. Charles.
