Case Against St. Charles Plan Commission Chairman Continues

The case against Chairman Todd Wallace stemming from a June traffic incident has been continued.
Wallace’s case was continued until May 25 at 9 a.m., according to court records. Wallace was scheduled to be in court April 16.

According to court records, Darlene Mitson claims 36-year-old Wallace was negligent when he made a right turn and struck her just before 9 p.m. on June 24 near First and Main streets. Mitson claims she was in the intersection with the walk signal when she was hit. In addition to the tickets, Wallace was served with a in December.
In September, Johnson issued a subpoena to obtain the woman’s medical records for the months immediately following the incident, but prosecutors objected on privacy grounds, court records show.

In the filings, prosecutors suggest the defense wanted medical information to attack the woman’s credibility due to her level of intoxication.
