There was some disagreement about the who had the green light. McIntire told police his combination commercial motor vehicle entered the intersection with a green arrow for a left turn. Smith said he was eastbound on East State with a green traffic signal when the Peterbilt pulled in front of him.

A witness “standing directly behind (the Peterbilt) advised the signal for westbound traffic was green with no arrow,” reports said. Smith was taken to Delnor Hospital; McIntire refused treatment, according to police reports.
