67-Year-Old Gets 8 Years for Sex Assault of Developmentally Disabled Girl

Gary R. Kluber was convicted of sexually assaulting a woman whose developmental disability has her functioning at a pre-adolescent level.

A St. Charles man and former Auroran has been sentenced to eight years in prison for sexually assaulting a developmentally disabled woman in the home of her boyfriend last June.

Gary R. Kluber, 67, of the 100 block of South 10th Avenue, St. Charles, who pleaded guilty Feb. 2 to a Class 1 felony county of criminal sexual assault, was sentenced late Wednesday, April 3, 2013, by Circuit Judge John A. Barsanti, according to a release from the Kane County State’s Attorney’s Office.

By Illinois law, Kluber must serve at least 85 percent of the eight-year sentence to the Illinois Department of Corrections, according to the release.

Kluber was given credit for time already served — at least 302 days in the Kane County Jail, where he had been held since his arrest in lieu of $250,000 bail, the release states. Bail was revoked upon conviction.

Authorities said the victim was visiting her boyfriend at his home on June 2, 2012, when Kluber also was present. The victim is 35, but because of her developmental disabilities, she functions as a pre-adolescent, authorities said. Kluber claimed he knew the victim well, and that she would call him “Uncle Gary.”

According to authorities, the woman’s boyfriend at one point went upstairs, and Kluber forced sexual contact on the victim despite her repeated pleas that he stop.

Afterward, the woman told her family, and St. Charles police interviewed Kluber. Authorities say he admitted to the assault, and blamed his actions on loneliness and depression since his wife’s death in 2006.

But during Kluber’s sentencing hearing, prosecutors led by Kane County Assistant State’s Attorney Pam Monaco presented Kluber’s criminal history, which included:

  • A sentence of supervision for a 1987 misdemeanor conviction for criminal sexual assault of a child.
  • A sentence of four years’ probation for a 1988 felony conviction for aggravated criminal sexual abuse.
  • And a conditional discharge sentence for a 2010 felony conviction for child sex offender present in a school zone.

In addition, authorities pointed out that since 2001, Kluber has amassed 17 convictions for driving on a suspended license and driving without insurance.
