Nicole Wiesner's Aggravated DUI Case Returns to Court

A status call is set for Dec. 5 at the Kane County Judicial Center before Judge Marmarie Kostelny.

The young Geneva woman who crashed at the intersection of Bennett and Dodson streets on May 4 returns to court Dec. 5.

Wiesner was charged in July with aggravated driving under the influence that included bodily harm to a passenger.

After the collision, Wiesner was driven to Provena Mercy Medical Center in Aurora. Her passenger, 22-year-old Lindsey Vanderheyden of Batavia, was lifted by helicopter to Good Samaritan Hospital in Downers Grove.

Vanderheyden initially told police Wiesner had fallen asleep behind the wheel as her Chevrolet Cavalier hurtled west down the Dodson Street hill, ran through the stop sign and crashed into trees next to a residential driveway at 224 N. Bennett St., which is also IL Route 25.

Eleven days after the crash, Wiesner drove a Chevrolet Cobalt north in the 600 block of North Kirk Road about 100 feet north of Geneva Drive around 7:40 p.m., when her Cobalt left the road and drove into a field, Geneva police reports said. At the time, she told police she was fixing her shoe when she looked up and drove the Cobalt off the road.

Wiesner was 20 at the time of the accidents in May.

According to the Kane County Circuit Clerk eServices Portal, Wiesner has a list of 12 violations dating back to 2008, including operation of an uninsured motor vehicle, consumption of alcohol by a minor, disorderly conduct, driving on a suspended license, inappropriate passing and driving 11-14 mph over the speed limit, among others.

State statutes define Aggravated DUI—Bodily Harm as "driving while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof. (a) A person shall not drive or be in actual physical control of any vehicle within this state while: under the influence of any intoxicating compound or combination of intoxicating compounds to a degree that renders the person incapable of driving safely."
